New Mediation Rules Cover Foreign IP Disputes

The China Council for the Promotion of International Trade (CCPIT) released mediation rules for intellectual property (IP) disputes on November 1.

The China Council for the Promotion of International Trade (CCPIT) released mediation rules for intellectual property (IP) disputes on November 1. These are the country’s first mediation rules covering disputes related to foreign IP.  

According to Cai Chenfeng, standing deputy director of CCPIT’s mediation center, the new rules support multi-language services and CCPIT has set up a joint mediation system with 21 worldwide centers to guarantee professionalism and internationalism.  

Chinese media reported the number of IP disputes grew by 24.5 percent annually on average since 2013, which cannot be coped with by time-consuming and costly litigation alone. 
 
Cai said the new rules detail the range of acceptable disputes, the application process, the appointment of mediators and the process and fees involved. He believes the new rules will greatly improve China’s institutions for solving IP disputes and promote legal system construction and participation in global IP governance.
